1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and KubeKanvas ("we," "our," or "us") governing your access to and use of the website located at www.kubecanvas.io(the "Site") and our Kubernetes visualization and management platform, including any related applications, tools, and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.

3. Eligibility

You must be at least 18 years old to use our Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age. If you are using the Services on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

4. Account Registration

To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

5. User Content

Our Services may allow you to create, upload, store, share, or otherwise make available certain content, including but not limited to Kubernetes configurations, text, graphics, and other materials (collectively, "User Content").

You retain all rights in, and are solely responsible for, the User Content you create, upload, or otherwise make available through the Services. By making any User Content available through the Services, you grant us a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, create derivative works based upon, distribute, publicly display, and publicly perform your User Content in connection with operating and providing the Services.

6. Prohibited Conduct

You agree not to:

• Use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services
• Use the Services in any way that violates applicable laws or regulations
• Use the Services to distribute malware or other harmful code
• Attempt to circumvent any content-filtering techniques we employ
• Attempt to access or search the Services through the use of any engine, software, tool, agent, device, or mechanism other than the software and/or search agents provided by us
• Collect or store personal data about other users without their express permission
• Impersonate or misrepresent your affiliation with any person or entity
• Violate any third-party rights, including intellectual property rights

7. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by KubeKanvas, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any rights to use the KubeKanvas name, logo, or other trademarks, service marks, or trade names, whether registered or unregistered.

8. Subscription and Payment

8.1 Subscription Plans

Some aspects of the Services may be available only with a paid subscription. By selecting a paid subscription, you agree to pay the subscription fees indicated for that service. Subscription fees are non-refundable except as required by law or as explicitly stated in these Terms.

8.2 Payment

We use third-party payment processors to bill you through a payment account linked to your account. Payment processing is subject to the terms, conditions, and privacy policies of our payment processors in addition to these Terms.

8.3 Subscription Term and Renewal

Subscriptions automatically renew for the same subscription term unless you cancel your subscription before the end of the current term. You may cancel your subscription at any time through your account settings or by contacting us.

9. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. KUBEKANVAS DOES NOT WARRANT THAT THE SERVICES ARE ERROR-FREE OR THAT ACCESS THERETO WILL BE UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KUBEKANVAS, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.

IN NO EVENT WILL KUBEKANVAS'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES EXCEED THE GREATER OF $100 USD OR THE AMOUNT PAID BY YOU TO KUBEKANVAS FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

12. Indemnification

You agree to defend, indemnify, and hold harmless KubeKanvas, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

13. Governing Law and Jurisdiction

These Terms and any action related thereto will be governed by the laws of Germany without regard to its conflict of law provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms will be the courts located in Wiesbaden, Germany, and you waive any objection to jurisdiction and venue in such courts.

14. Dispute Resolution

Any dispute arising from these Terms shall first be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be resolved through arbitration in accordance with the rules of the German Arbitration Institute (DIS).

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and KubeKanvas regarding our Services and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter of these Terms.
